Terms of Service

These terms apply to Property Screens and Fecund Five bundles supplied by James Dobbin trading as Fecund Property Intelligence, ABN 57 787 911 290 (“Fecund”, “we” or “us”). Fecund is not registered for GST and no GST is charged.

The service

A Property Screen is preliminary, property-specific decision support based on the proposed use you describe and the authoritative and other identified material reasonably available to us. It identifies relevant rules, evidence, constraints, uncertainties and useful next questions. It is not a planning permit, approval, title or survey advice, engineering or building certification, legal advice, valuation, finance advice or a guarantee that a proposal will be approved or can be constructed.

One Property Screen covers one property and one reasonably defined intended use. It includes one bounded update where a decisive missing item identified in the report is later supplied. Materially different proposals, additional properties or substantial new research are separate work.

Prices and bundles

The current introductory prices are A$150 for one Property Screen and A$500 for five Property Screens. The normal prices displayed on the website are A$249 and A$999 respectively. The price shown on the order review and Stripe checkout is the price charged.

A Fecund Five purchase provides five separate Property Screen credits, not one combined report. Credits are valid for 12 months from purchase, are for the purchaser’s use and are not redeemable for cash, subject always to rights that cannot lawfully be excluded.

Your information

You must provide accurate and reasonably complete information about the property, intended use, timing and material already available to you. You remain responsible for checking the report against current documents and obtaining any professional advice, authority confirmation, permit or approval required before relying on a proposal or committing further money.

Timing

Reports are usually delivered within five business days after we receive a complete property brief and the material required to begin. The period does not begin merely because payment has been made if essential information is missing. We will tell you if unusual source availability, system failure or the nature of the property is likely to cause a material delay.

Serviceability and refunds

You may pay immediately after submitting the initial enquiry. If we determine that we cannot reasonably provide a meaningful Property Screen for the property, we will cancel that order and refund the payment in full to the original payment method.

You may request a change-of-mind cancellation before substantive property research begins, in which case we will refund the payment in full. Once substantive research has begun, we do not ordinarily provide a change-of-mind refund. Nothing in these terms excludes, restricts or modifies any consumer guarantee, remedy or other right that cannot lawfully be excluded under the Australian Consumer Law. If the service has a problem, contact us so it can be assessed and an appropriate remedy provided.

Sources, change and professional confirmation

Planning instruments, mapping, property records, listings and agency information can be incomplete, inconsistent or changed after retrieval. Reports state the sources and retrieval context used and identify important matters requiring confirmation. You should obtain current confirmation from the relevant authority or appropriately qualified professional before making a final purchase, development, construction or legal decision.

Report use

The report is prepared for the customer and the stated property decision. You may share it with your professional advisers and people directly involved in that decision. It should not be resold, republished as general advice or represented as an approval or professional certification.
