Our commitment

Fecund Property Intelligence respects your privacy. We collect only the information we reasonably need to respond to enquiries, provide our property intelligence services, process payments and improve the operation and security of our website.

This policy explains how we collect, use, store and disclose personal information.

In this policy, “Fecund,” “we,” “us” and “our” refer to James Dobbin, ABN 57 787 911 290, trading as Fecund Property Intelligence.

Information we collect

Depending on how you interact with us, we may collect:

  • your name, email address and telephone number;
  • the address or lot description of a property;
  • information about what you want to do with a property;
  • your decision timeframe and service selection;
  • property listings, plans, reports, correspondence or other documents you choose to provide;
  • communications between you and Fecund;
  • payment status, transaction references and related billing information;
  • information generated while preparing and delivering your report; and
  • technical information such as your IP address, browser, device type, date and time of access, and basic website activity.

Please do not send contracts, identity documents, financial records or other sensitive material through the initial website enquiry form. If additional documents are needed, we will explain how to provide them securely.

How we collect information

We generally collect information directly from you when you:

  • submit an enquiry;
  • communicate with us by email or telephone;
  • make a payment;
  • provide information through a secure workspace; or
  • request or receive a property intelligence report.

When preparing a report, we may also obtain property-related information from publicly available or authoritative sources, including government agencies, councils, planning schemes, mapping services, property listings and documents you or your representative provide.

We do not knowingly purchase personal-information lists or collect information for unrelated marketing databases.

Why we collect and use information

We may use your information to:

  • assess whether your property and question fit our service;
  • respond to your enquiry;
  • prepare, review and deliver a property intelligence report;
  • contact you about missing information or important uncertainties;
  • create and administer your secure workspace;
  • process and reconcile payments;
  • maintain appropriate business and transaction records;
  • respond to questions, access requests, corrections or complaints;
  • protect our website, systems and customers from misuse or security threats;
  • improve our services and customer experience; and
  • comply with legal, regulatory, insurance and accounting obligations.

We will not use your information for an unrelated purpose unless you consent or the use is permitted or required by law.

Property information and report materials

A property address is not always personal information by itself, but it may become personal information when connected with an identifiable owner, buyer, vendor or occupant.

We treat customer-supplied property documents and the contents of our reports as confidential. We do not publish your report, property plans or enquiry without permission, except where disclosure is required by law.

We may use de-identified information to improve our research methods, report structure and service. We will take reasonable steps to remove details that identify you before doing so.

Payments

Payments may be processed by Stripe or another payment provider identified at checkout. Payment providers collect and process payment-card information under their own privacy policies and security arrangements.

Fecund does not intend to receive or store your complete card number or card security code. We may receive information such as your name, email address, billing details, payment status, amount paid and transaction reference so we can confirm and administer your order.

You should review the payment provider’s privacy policy before completing payment.

Secure workspace and service providers

We may use trusted providers to operate parts of our service, including:

  • website and database hosting;
  • email delivery;
  • secure document storage or customer workspaces;
  • payment processing;
  • backups, security and technical support; and
  • professional advisers where reasonably necessary.

These providers may process information only to the extent necessary to supply their services to us or as otherwise described in their own terms and privacy policies.

Our current principal providers include:

  • Website hosting: Contabo (infrastructure may be located outside Australia)
  • Email delivery: Brevo (data storage within the European Union)
  • Secure workspace and document storage: Contabo (infrastructure may be located outside Australia)
  • Payments: Stripe Payments Australia Pty Ltd and its related service providers
  • AI-assisted report processing: OpenAI API (processing may occur outside Australia)

We may use the OpenAI API to assist with research, analysis and drafting. Relevant property and enquiry information may be included in that processing. OpenAI states that API inputs and outputs are not used to train its models by default.

Some providers may store or process information outside Australia. Where this occurs, we will take reasonable steps appropriate to the circumstances to protect the information and assess the provider’s privacy and security arrangements.

Cookies and technical information

Our website may use cookies and similar technologies required for functions such as security, form operation, preferences and site administration.

Our enquiry form may record your IP address and device or browser information. We use this information for form processing, security, troubleshooting and preventing misuse.

We do not currently use personal information for third-party behavioural advertising. If we introduce analytics, advertising pixels or materially different tracking, we will update this policy and provide any notice or choice required.

You can configure your browser to reject or remove cookies, although some website functions may then work differently.

Marketing

We may contact you about the enquiry or service you requested.

We will only send broader promotional email where you have consented or where otherwise permitted by law. Marketing messages will provide a practical way to unsubscribe. Service communications concerning an active enquiry, payment or report are not marketing messages.

We do not sell or rent personal information to third parties.

How long we keep information

We retain information only for as long as reasonably needed for the purpose for which it was collected and for applicable legal, accounting, insurance and dispute-resolution requirements.

Our intended retention periods are:

  • unsuccessful or unproceeded enquiries: up to 2 years after our last contact;
  • customer correspondence and report working materials: up to 7 years after the service is completed;
  • delivered reports and supporting evidence records: up to 7 years after delivery;
  • payment and accounting records: at least 5 years after the relevant transaction, or longer where required by law; and
  • website security logs: generally up to 90 days, unless needed to investigate an incident or comply with law.

When information is no longer required, we take reasonable steps to delete it, securely destroy it or de-identify it, subject to backup cycles and legal obligations.

Security

We take reasonable administrative, technical and physical steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure.

These measures may include access controls, secure connections, restricted administrative access, backups, software updates and the use of reputable service providers.

No internet transmission or storage system is completely secure. If we become aware of a data breach, we will assess and respond to it and make notifications where required by law.

Accessing or correcting your information

You may ask us to:

  • tell you what personal information we hold about you;
  • provide access to that information; or
  • correct information that is inaccurate, incomplete or out of date.

Contact us using the details below. We may need to verify your identity before responding. We will respond within a reasonable period and explain any lawful reason why we cannot fulfil a request.

Deleting or withdrawing information

You may ask us to delete information or withdraw consent to a particular use. We will honour the request where reasonably possible, but we may need to retain some records for legal, accounting, insurance, security or dispute-resolution purposes.

Withdrawing necessary information may mean that we cannot continue an enquiry or provide a report.

Third-party websites

Our website and reports may link to councils, government agencies, payment providers and other third-party websites. We do not control the privacy or security practices of those organisations. Their own privacy policies apply when you use their services.

Children

Our service is intended for adults making or supporting property decisions. We do not knowingly solicit personal information directly from children.

Changes to this policy

We may update this policy when our services, providers or legal obligations change. The current version will be published on this page with its effective date.

Material changes affecting existing customers will be communicated where reasonably appropriate.
